Assessment and Training Terms & Conditions
DEFINITIONS
We, Company or Centre means Health, Safety & Environmental Compliance Services Limited also known as HSEC Services Ltd. Contract means the contract for the provision of Services by the Company to the Client. You or Client means the persons, firm or company ordering or buying Services from the Company.
Service means the provision of training services by the Company to the Client. Intellectual Property and Rights means any patents, copyright related rights, trademarks, trade names and domain names, rights in goodwill or to sue for passing off. Order means the written order sent by the Client for the supply of Services by the Company and includes a training booking form, letters, faxes and emails whether sent by post or electronically.
GENERAL
These terms are in addition to any other terms and conditions agreed between the Company and the Client for the provision of any other services. The submission of a training booking form constitutes a legally binding contract and must be returned as soon as possible in order to secure the training dates required; this should be a minimum of 4 weeks prior to the course start date. If the form is returned after the deadline, the course may not go ahead as planned.
Booking forms for courses booked within 4 weeks of the course start date must be returned immediately once the date has been agreed verbally. The Company also has the right to use the Clients logo’s, trademarks for all sub companies and parent companies for the purpose of advertising, on both social media and its website www.hsecservices.co.uk.
ACCEPTANCE OF BOOKING
No contract between the Company and Client shall exist until a booking has been accepted in writing by the Company. An acceptance by the Company incorporates the Terms and Conditions and the Client shall be deemed to have accepted the Terms unless the Client notifies the Company in writing of any objections to the Terms within seven days of the date of acceptance.
No conditions or terms stipulated in any other communication or document shall amend or exclude any of the terms except insofar as the same is expressly consented in writing by the Company.
Please note it is the responsibility of above-named Learner and / or their employer to confirm with the regulator the award is correct for their permitted facility type, Health, Safety & Environmental Compliance Services Ltd will accept no liability where the award selected is not suitable for a given permitted facility.
FEES
All course fees are to be paid in full before the commencement of any course or qualification. VAT will be applied at the applicable rate at the time the course is booked.
In the absence of full payment of course fees, the training may be withdrawn in accordance with the Late Payment of Commercial Debt (Interest) Act 1998, we will be entitled to charge interest at 5% above the Bank of England base rate on all overdue amounts. Payment by credit card will attract a 2% handling charge. Please note our payment terms at NET 15 Days, from date of invoice.
CANCELLATION BY THE CLIENT (MUST BE MADE IN WRITING)
On receipt of the completed booking form via email or through our website an invoice will be raised, once payment has been received, should the Client wish to cancel the Company will offer a 90% refund if cancelled within 14 days, unless delivery of qualifications or training begins such as being registered with an awarding organisation or receiving training, an induction or assessment visit(s). After registration a 60% refund will be offered, however after you receive an induction visit or any joint or separate assessment visit(s) any amounts refunded are at the discretion of the Company Director. All funds will be returned within 60 days from end of month (OEM).
Where the award selected is not suitable, or the route selected needs to be changed the centre will transfer any remaining balance, which can be applied to the new qualification or training, minus any previous costs incurred.
Learners and their Employers are required to notify both the centre and their allocated assessor at least 7 days in advance of any cancelation. Where assessments are cancelled within 7 days of the agreed visit date, a charge of up to 30% of the qualification fee maybe incurred.
INTELLECTUAL PROPERTY
All intellectual Property Rights in the Services or arising from the Contract shall remain with the Company, unless expressly otherwise agreed in writing by the Company.
The reproduction by whatever means, of the Company’s publications or any publication used by the Company in the performance of the Contract is expressly forbidden and the Company will not hesitate to take legal proceedings in respect of any breaches.
If the Services are to be provided by the Company in accordance with a specification submitted by the Client, the Client shall indemnify the Company against all liability, loss, damage, costs and expenses suffered or incurred by the Company in respect of any claim for infringement of any intellectual Property Rights of any other person which results from or arises out of the use of the client’s specification.
COURSE CONFIRMATION AND MATERIAL
Confirmation of reservations for training courses and any required pre-course reading will be forwarded to you on receipt of full payment for the training course otherwise it will be made available on the first day of the course itself.
ISSUE OF DOCUMENTATION
Once in receipt of the full payment amount, the Company will register you with the awarding organisation. Once registered, we will send an electronic registration letter to confirm your registration. Your allocated assessor will bring all the required course materials on the first assessment visit.

FORCE MAJEURE
The Company shall not be liable to the Client or be deemed to be in breach of Contract by means of any delay in performing or failure to perform any of the Company’s obligations in respect of the Services or the Contract if the delay or failure was due to any cause beyond the Company’s reasonable control.
CHANGES AND CANCELLATION OF EVENTS
The Company reserves the right to revise the costs stated above, not to start the proposed course/s, accept intakes into existing courses and to cancel the course if enrolments do not meet the required minimal numbers.
It is the Learner / Delegates responsibility to provide us with up to date information in respect of his / her employer, address, name(s) ect.
ADDITIONAL CHARGES – CIWM (WAMITAB) LEVEL 4 QUALIFICATIONS
In the event the qualification is not completed the Centre can re-register you at a flat cost of £180 + VAT per Learner for a low-risk award, £230 + VAT for a medium-risk award and £460 + VAT for high-risk award, any additional assessment visits required will be chargeable at a flat rate of £600 + VAT per assessment visit. Additional assessment visits are only required where the Assessor has confirmed an assessment within 7 days, and then turns up on site and the Learner has either done nothing or the assessment can’t go ahead as the Learner has meetings or other work which takes priority over the assessment or where the learner was unable to complete the award within the 4 visits included.
Additional charges will apply to all qualifications and training delivered outside the UK mainland, to include Isle of man, Isle of white, Jersey, Guernsey and international delivery.
REQUIREMENTS - CIWM (WAMITAB) LEVEL 4 OPERATOR COMPETENCE (RQF) QUALIFICATIONS
Once registered each Learner has 24 months to achieve their award. In order to achieve the award, the Learner and their Employer understands, this process requires access to an operational facility, carrying out the required activity under an environmental permit. The facility must have the required resource to include management systems, procedures, documentation, machinery, plant and people to demonstrate the Learner has the required level of knowledge and skill to achieve the award.
Where the Learner requires the award for a new permit application, and there for does not meet the above requirements, the use of a surrogate site can be used providing the Learner can be granted access to the above required resource and is involved in the site for the purposes of achieving the award.
